Scope of Services: DL320 provides architectural rendering services as described in the project proposal or contract. Any additional services requested will be subject to additional fees.
Payment Terms: Clients are required to make a non-refundable deposit 50% before the commencement of work. The remaining balance is due upon completion of the project. Late payments may incur additional charges.
Work Product: All rendered images and designs created by DL320 Studio are digital visualizations intended for illustrative purposes only. These visualizations are not real photographs and should not be interpreted as such. While we strive to provide accurate and realistic representations of architectural and design concepts, the images and designs produced are computer-generated and may not fully reflect the final physical appearance or construction of the project. DL320 Studio makes no representations or warranties regarding the real-world accuracy or completeness of these visualizations.
Intellectual Property:
Ownership of Intellectual Property – All rendered images, designs, and related materials created by DL320 Studio (collectively, the “Work Product”) are the exclusive intellectual property of DL320 Studio. We retain all rights, title, and interest in and to the Work Product, including any copyrights and other intellectual property rights, unless otherwise agreed in writing.
License Grant – Upon receipt of final payment in full for the services rendered, DL320 Studio grants the client a non-exclusive, perpetual, and royalty-free license to use the rendered images and designs for the specific purposes outlined in the project agreement. This license allows the client to reproduce, display, and distribute the Work Product in connection with their project.
Attribution – The client agrees to acknowledge DL320 Studio as the creator of the Work Product in any public display or publication where the Work Product is used, provided such acknowledgment is reasonably possible.
Reversion of Rights – In the event that final payment is not received as stipulated in the project agreement, DL320 Studio reserves the right to retain ownership of all intellectual property rights in the Work Product and may restrict or revoke the client’s license to use the images and designs.
Revisions: Dependent upon the anticipated size and type of the project and the amount of work required by same, each client is allotted a set number of revisions they may request which shall be specified in the project proposal. Additional revisions may be subject to additional fees.
Delivery Time: DL320 provide an estimated delivery time for the project. While we strive to meet deadlines, delays may occur due to unforeseen circumstances. DL320 notify the client of any changes to the delivery schedule.
Client Responsibilities: The client is responsible for providing accurate project specifications, including architectural drawings and design preferences, in a timely manner. Delays in providing necessary information may result in project delays.
Confidentiality: DL320 will treat all client information and project details as confidential and will not disclose them to third parties without consent, except as required by law.
Liability: DL320 Studio shall not be liable for any discrepancies, inaccuracies, or misinterpretations arising from the use of these visualizations. Users acknowledge and agree that DL320 Studio is not responsible for any direct, indirect, incidental, consequential, or special damages that may result from reliance on or use of these visualizations. It is the responsibility of the user to verify all details and specifications with actual project plans and construction documents.
Termination: Either party may terminate the contract with written notice if the other party breaches any terms of the agreement. Upon termination, the client is responsible for payment for services rendered up to the termination date.
Governing Law: This agreement shall be governed by the laws of Massachusetts. Any disputes arising out of this agreement shall be resolved through arbitration in Boston, Massachusetts, in accordance with the rules of the American Arbitration Association.
